Online Terms & Conditions

1- Lenses we supply Online

1.1- We supply prescription lenses online with powers up to and including:

Sph's from 0.00 to 4.00 (+/-) Dioptres and opposite Cyl's 0.00 to 2.00 (+/-) Dioptres inclusive and Reading Adds up to +3.00 Dioptres Inclusive without prisms.

1.2- We don't supply complete glasses or lenses on this website above the powers indicated and you must not place an order for glasses or lenses above these powers. 

1.3- An administration charge of  £15.00 will be applied to orders placed with us without permission for complete glasses or lenses with prescriptions or prisms above these powers before a refund of the balance is made.

1.4- At our discretion we may complete an order with a prescription above the powers we state we supply online on this website. If there are any additional charges we will notify you the buyer before continuing with your order or deducting the administration charge and making a balance refund payment.

1.5- Prescription glasses and lenses should not be ordered on this site where you have been referred to the eye doctor or eye hospital and orders found to be made in these circumstances will be subject to our administration costs indicated on 1.3 before we make a refund.

1.6- We reserve the right to check your used written prescription from your optician at any time when an order is placed with us on this site.

 

2- Payments

 

2.1- We accept payment by credit and debit card (BACS Transfer by prior arrangement & Cheque by prior arrangement.
2.2- All prices for frames and lenses are as indicated and shown on this website and are the price you pay in total + postage if applicable.

2.3- Goods will only be delivered to the registered address of the credit card used for payment.
2.4- Goods remain the property of "Ilkeston Factory Specs"

3- Delivery for sent and returned goods


3.1- We do not guarantee to deliver goods ordered on this site by a specific date other than as outlined within these terms and conditions.  

3.2 If we have received your order or your goods to work on and not returned (sent back by post) the products ordered by you within 28 days of our acceptance of your order or receipt of your sent goods, you may cancel the order and all money paid will be refunded to the credit or debit card that the payment originally came from.

3.3-  Spectacles can only be supplied to United Kingdom residents and delivered to a United Kingdom address including England Scotland and Wales but not including Ireland.
3.4- We will send (all) goods ordered by Royal Mail Signed for 2nd class delivery or Royal Mail Special Delivery Insured (if you choose to insure your goods) and it is your responsibility to ensure that someone is able to sign for receipt of the goods. We will email you the day we send out your goods but cannot guarantee the exact delivery day and time.

3.5- We will be entitled to rely upon your signature as proof of delivery/ a neighbours signature if taken on your behalf/ or a statement of delivery signed on your behalf by the Royal Mail employee attending and making the delivery in the case of Covid 19 distancing rules. In all cases the delivery will be deemed to have been successful and made.
3.6- You should Inspect the goods upon delivery and notify us straight away on the  day of receipt  (by email through our Ilkestonfactoryspecs.co.uk website contact form ) should they be in any way defective or inconsistent with your order. If this is the case you should not use the product or wear the product.

3.7- All Damage to goods and or missing items to or upon the delivery must be reported on the day of receipt of the goods to ourselves and the Royal Mail.

3.8- Should it be necessary for you to return goods then you shall be liable for their safe-keeping until such time as they are delivered to us including any period in transit.

3.9- The returned spectacles or goods should be returned unmarked and in their original packaging for our inspection and acceptance and returned at your own cost.

3.10- Goods returned as faulty, damaged or not accurate or as described will not be considered returned until we sign for and receive them at Ilkeston Factory specs trading address.

3.11- Should returned goods not arrive back to us no refund will be made for original monies paid.

 

4 - Reframe Own Lenses and Reglaze Own Frames Orders

4.1- You agree when sending your own frames or lenses to us that the value of the items you send (lenses and frames for us to work with, including reglaze own frame orders and reframe own lens orders) have a value of £0 nothing if lost in return transit or if damaged within our glazing processes.

4.2- Initial order - In the event of your own goods you post to us for us to work on getting lost in transit or not arriving at our premises for us to fulfil your initial order, (in particular your own lenses for our reframe service and your own frames for our reglaze service) you agree to wait a minimum of 56 working days from the date of your return postage receipt before requesting a refund for payments made to us in advance for the work we cannot perform without your items.

4.3- Ilkeston Factory Specs can only accept inward goods sent to us to work on during working days (hours) which are Mon, Tue, Thur, Fri, Sat. Failed delivery attempts on our non working days inc Bank Holidays and any Wednesday or Sunday may be subject to re-delivery by your courier or Royal Mail on a day of their choice which may delay our receipt and completion of your order and is to be deemed beyond our control.

4.4-In the event of your goods not arriving at our premises so that we can perform our part of the original contract, you agree when placing orders on this site to accept an administration and handling charge of £15.00 This will be deducted from your payment before we make a refund (of the balance minus £15). This covers bank charges made to us from your credit provider when you made your payment and time spent administering the matter.

4.5- You agree to show us upon request a forward proof of postage receipt before we can deem a parcel sent and lost and any refund made.

4.6- When choosing Special Delivery, Insured Goods sent out to you on completion (reframes and reglazes) usually take between 1 and up to 7 working days to arrive. You agree that the goods will not be considered lost in transit until a minimum of 28 working days has passed.

4.7- When choosing Signed for 2nd class delivery, goods sent out to you on completion usually take between 2 and 14 days to arrive. You agree that the goods will not be considered lost until a minimum of 56 working days has passed.

4.8- You agree not to claim from Ilkeston Factory Specs any amount of financial compensation for lost or damaged goods unless you have chosen Special Delivery Insured return postage on our website, protecting us against loss.

4.9- You agree that you accept full liability and will not hold us liable for goods being lost when you send them to us.

4.10 - You will not send lenses of  high value etc without first contacting us by email, as these types of lenses will be deemed at a value of £0 in the event of loss or damage due to them being unusable as a working pair of glasses.

4.11 - Ilkeston Factory Specs does not guarantee specific delivery dates or next day delivery with goods sent out when using 2nd class signed for or Special Delivery post.

4.12 - Frames supplied for reframe online will be of our choice and as we deem suitable and cannot be changed at a later date.

4.13 - Reframes Online must be posted to us and will be shipped back to you once completed and cannot be collected from store.

 

5 - Cancellations and Changes for spectacle and reframe and reglaze orders


5.1- Bespoke glasses or lenses are exempt from long distance selling laws and cannot be returned unless faulty, defective or not as described (bespoke - goods made or prepared to your personal specification).

5.2- Spectacles and bespoke products are exempt from changes and cancelation before dispatch. Changes to your order made before dispatch are at our discretion. If we decide to accept changes to your order before dispatch you may incur an additional charge for time and materials used in preparation of the order which we will let you know of before we undertake the changed order in place of the original. We reserve the right to perform and complete the original contract if you or we cannot accommodate the changed instructions.

5.3- Wrongly placed orders or orders placed not in line with the possibilities and options shown as available on this site, cannot be canceled without our consent, but if we do consent we may make reasonable charges to cover costs from your credit or our payment providers and intermediaries, and for our time spent in administering a wrongly placed order.

5.4- Spectacles and bespoke products are exempt from the 14 day cooling-off period upon your receipt, that applies to the majority of consumer goods and we do not offer refunds for correctly (contractually) supplied spectacles or lenses.
5.5- You accept full responsibility for the accuracy and of entering ( or uploading) your prescription details and providing your PD measurement.

5.6- If you do not provide a PD measurement (or use the option "Set at Standard" when ordering ), we will apply automatically the PD measurement as a total of 63 mm (average)  for long distance and 60 mm for near distance decentration on the manufacture of the spectacles or lenses you have ordered. Likewise, the lens setting heights (for prisms and varifocals) will be as marked by you with a dot on the lens, or 5mm above the lens centre as is an average if your buying new spectacles..
5.7- You may cancel any order (except for bespoke or prescription glasses, Reglazes and Reframes) up to 14 working days after receipt and return the goods for a full refund.  You must notify us in writing or by email before you do so.

5.8 - We cannot be responsible for altered pupil distance settings or and height measurements when your own lenses are fitted to our new Reframes but will do our best to match as near as possible.

5.9 - The choice of frame we use for your reframe is of our choice and as deemed suitable and you agree to accept our choice of style/colour and fit .

 

6 - Guarantee

6.1 -  All Unbranded spectacles sold online carry a 6 month guarantee against faulty or defective materials and defective workmanship. Designer Branded glasses cary the same but 12 month guarantee. This does not include wear and tear, accidental damage or misuse of the goods. To claim under this guarantee you must obtain a returns number by sending an email to us on our website

Ilkestonfactoryspecs.co.uk contact form and then returning the goods by post. Please do not attend store for refunds unless with our express permission. Refunds will not be made for original or return postage.

6.2- We reserve the right to repair or replace faulty goods at our discretion if we deem the goods to be faulty after 30 days has passed from receipt of the goods.

6.3- Guarantees will not apply where goods have been subject to misuse, have not been used for the intended purpose or have not been used or cared for in accordance with any specific instructions issued with the product.

6.4- Refunds will not be made if incorrect or insufficient prescription information has been entered or supplied by the buyer at the time of ordering. 

6.5- We reserve the right to see a copy of the original prescription before making alterations or a refund.

 

7 - Liability


7.1- "Ilkeston Factory Specs"  will not be liable for any vision problems, any loss of any nature, any accident or any injury, as a result of incorrect or insufficient information supplied by you or the original prescribing Optician or qualified optical professional.
7.2- The Buyer (customer) accepts full responsibility for choosing the frame based on the information provided. Unless stated otherwise, frames are not supplied as 'non-allergenic'.

7.3- Upon receipt of your spectacles, the responsibility lies with you the buyer to check that the vision through the lenses meets your expectations for the purpose that they were ordered. i.e. reading glasses and lenses are for near vision within arm's length only. Distance glasses and lenses are for distance vision giving clear vision at distance only but not focusing at a near vision (within arms length).

7.4- PD measurements supplied by you when ordering online are used by us to make your glasses up in good faith of their accuracy and you will be liable for their suitability and not hold Ilkeston Factory specs liable for their accuracy.

7.5- If you request your PD measurements taken by Ilkeston Factory specs Instore (and we deem it reasonable to give them to you) they will remain the property of Ilkeston Factory Specs for their sole use and you agree not to hold us liable for any inaccuracy in this measurement if you decide to use this measurement online or elsewhere with an unassociated supplier.

 

8 -  General terms


8.1 - We reserve the right to amend prices and specifications without notice.
8.2- No employee of "Ilkeston Factory Specs" has the right to vary these terms and conditions.

 

8.3- These terms and conditions shall be governed by English Law.

8.4- We can only supply lenses to a valid prescription that is less than two years old and we reserve the right to ask for a copy of the original of that prescription.
8.5- We cannot supply lenses to those who are under 18 or registered partially sighted.

 8.6- You declare that your prescription is not more than 2 years old as governed by the supply of prescriptions spectacles laws in the uk and is a valid prescription supplied by a qualified optician under 2 years ago.
8.7- A binding contract is only entered into when we accept your order.

8.8- Prescription lenses we state we supply on this website are sold at the price indicated at the cart and include frames and lenses as indicated. We do not accept orders with prescriptions above Sph's +/- 4.00 and or opposite Cyl's above +/- 2.00 or Adds above 3.00 or with prisms. Please do not place orders for glasses or lenses above these powers on this website.

8.9-  There will be a £15.00 administration charge for orders placed for glasses or lenses with prescription lenses above the powers we state we supply for the time and expenses incurred (by us) for your error in placing an order with us . This will be deducted by us from the monies paid to us by you before a refund is made. We make refunds by cheque.

You should not place an order for lenses, frames or glasses with us if your prescription is over the powers we accept unless you agree with the terms and fee's stated on this website and understand our administration charge policy for invalid orders.

9 - Force majeure

 

9.1-  in the event of unforeseen events or events beyond our control including but not limited to disasters, emergencies, exceptional weather conditions and strikes effecting production or delivery (through a third party postal service) of ordered products on this site, while the circumstances persist the terms set here throughout shall be suspended until we or they are reasonably able to continue to perform the contract or contracts made without undue delay, and the original terms can be reinstated.

 

10 -  Statutory rights

 

10.1 - Nothing in these terms and conditions shall effect your statutory rights

In-store Terms & Conditions

 

 

1 - Eye tests

 

1.1- We will provide glasses with prescription lenses to the prescription you provide us in good faith of its accuracy and that it will be suitable for your vision requirements.

1.2- You declare you have supplied us a valid prescription supplied by a registered qualified optician that is

two years old or less.

1.3- You declare you are 16 years old or over and not referred or registered with the eye hospital when using our services and buying our products in-store.

1.4- You agree not to hold Ilkeston Factory Specs liable for remedy or refund If the prescription provided by your optician subsequently proves to be inaccurate or incorrect or unsuitable.

1.5- If you obtain a retest due to the unsuitability of the original eye test (from your original chosen optician) and therefore the performance of the glasses or lenses we have supplied to you, you agree to provide us with a copy of any retest (prescription you want to rely upon) conducted by any qualified optician and inform us of any remedy offered or taken up by you with the third party.

1.6- You agree that any remedy or compensation you take from a third party to satisfy an inaccurate or unsuitable prescription including free replacement frames or lenses removes any further liability or obligation from us and you will not expect or ask us to make a refund or further changes by way of enhancement.

 

2 - Pupil distance measurements

2.1 - Specific measurements, pupil distance measurements and multifocal height settings are as we measure or feel are suitable and best practice when comparing existing glasses measurements remain our sole opinion and property for our use in manufacture. You agree to accept the measurements we assess or alternately you may provide these measurements (at point of order in-store) on which we will rely upon when making your glasses.

2.2- PD measurements supplied by you when ordering In-store are used by us to make your glasses up in good faith of their accuracy and you will be liable for their suitability and not hold Ilkeston Factory specs liable for their accuracy.

2.3- If you request your PD measurements taken by Ilkeston Factory specs In-store (and we deem it reasonable to give them to you) they will remain the property of Ilkeston Factory Specs for their sole use and you agree not to hold us liable for any inaccuracy in this measurement if you decide to use this measurement elsewhere with an unassociated supplier.

 

3 - Lens Brands

 

3.1- We reserve the right to use prescription lens brands of our choice unless you request a specific brand of lens which we will then document on your order docket.

 

4 - Tints & Coatings

4.1 - We reserve the right to use prescription lens coatings of our choice unless you request a specific brand. 

4.2 - Exact tint shades and depths cannot be guaranteed and are not the "essence" of the contract made with Ilkeston Factory Specs for the supply of tints although we will take every care.

4.3 - Exact colour depth of photochromic type lenses when fully reacted varies from one brand to another and exact colour/depth does not form the "essence" of a contract made with Ilkeston Factory Specs when we supply photochromic lenses. We will provide Sunlite photochromic reactive lenses, widely used around the Uk unless otherwise stated.

 

5 - Reglazing

 

5.1 - When glazing your own frames we cannot accept liability for damage or breakage although we will take every care with your frames.

5.2 - We cannot accept liability for altered Pd pupil distance settings when reframing your lenses into one of our new frames although we will take every care to work as accurately as possible.

 

6 - Deposits

 

6.1 - Orders in store and deposits made in store are non refundable and we reserve the right to pursue any balance payments owed to us on completion of your order made.

6.2 - You agree to perform to the terms of the contract, assist promptly in aiding us to complete the contract.

6.3 - You agree to make payment of any balance payment due to us upon our notice of completion (by email or telephone) of the contract (your order) without delay and within 2 weeks of completion.

 

7 - Timescales

 

7.1 - Time scales for completion of glasses are an estimate and don't form part of the "essence" of any contract made for the supply of products or services with Ilkeston factory specs.

 

8 -  Responsibility of choice

 

8.1- products/ lenses and frames are your choice when placing an order and cannot be changed or altered by you at a later point without our agreement.

 

9 - Collection and returns

 

9.1 - You agree to inspect your glasses on collection to ensure they are as described and free from minor defect.

9.2 - In the unlikely event that you later find a defect with your glasses/purchase you should let us know and not use the goods and return them to store as soon as possible and in any event within 7 days.

​9.3 - By using our services or making an order with us at Ilkeston Factory Specs either online or in-store

you agree to be bound by the mentioned terms.
